Terms of Service

1. Service provider

PumpFlow is operated by PumpFlow (hereinafter "PumpFlow", "we"), with registered office at Madrid, Spain, tax ID registered as autónomo in Spain, registered in the Commercial Registry of N/A (sole trader). Contact: hello@pumpflow.co.

2. Service description

PumpFlow is a SaaS platform offering an AI assistant for HVAC companies (heat pumps, air conditioning, heating). The service lets you:

• Receive and respond to WhatsApp messages automatically
• Qualify leads through AI conversations
• Book appointments and sync them to Google Calendar
• Manage leads from a dashboard

3. Account and access

To use PumpFlow you must create an account with truthful information. You're responsible for keeping your password confidential and for all activity on your account.

You must be at least 18 years old and have legal capacity to contract. If you use the platform on behalf of a company, you represent that you're authorized to bind that company to these terms.

4. Acceptable use

You agree not to:

• Use the service for illegal, fraudulent, or deceptive activity
• Send spam, unsolicited messages, or content that violates WhatsApp Business policies
• Impersonate others or falsely claim affiliation
• Attempt unauthorized access to accounts, systems, or networks
• Reverse-engineer, decompile, or extract the service's code
• Use the service to compete with PumpFlow or replicate its functionality
• Deliberately overload our systems (DDoS, mass scraping)
• Process third-party personal data without a legal basis

Violations may result in immediate suspension or termination without refund.

5. Subscriptions and payments

PumpFlow is offered as a monthly subscription. Prices are published on our website and include applicable VAT.

• Billing: monthly, charged in advance via Stripe
• Free trial: 14 days for new users (no card required to start)
• Auto-renewal: your subscription renews automatically until you cancel
• Plan changes: you can change plans any time from the dashboard
• Failed payments: after a failed charge attempt, we suspend service. If not resolved within 15 days, the account is cancelled

6. Cancellation and refunds

You can cancel your subscription any time from the dashboard. Cancellation takes effect at the end of the current billing period (no refunds for unused time).

Right of withdrawal (consumers): if you're a consumer, you have 14 calendar days to withdraw without cause, except when we've started providing the service with your express consent (which occurs upon starting to use it).

7. Intellectual property

The service, its code, design, trademarks, and content are owned by PumpFlow. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service under these terms.

You don't acquire any rights to our intellectual property beyond that license.

8. Customer data

The data you enter into PumpFlow (company info, leads, conversations) is yours. You grant PumpFlow the license needed to operate the service (process, store, transmit it).

If terminated, you may export your data during the following 30 days; after that it will be deleted unless legal retention obligations apply.

9. AI-generated content

PumpFlow's assistant uses third-party AI models (Anthropic, OpenAI). Responses are generated automatically and, while we make reasonable efforts to ensure quality, we don't guarantee accuracy, completeness, or fitness for a particular purpose.

You're responsible for reviewing responses before acting on them, especially on contractual, financial, or legal matters. PumpFlow isn't liable for business decisions made based on assistant responses.

10. Service availability

We make reasonable efforts to keep the service available 24/7, but we don't guarantee uninterrupted availability. Outages may occur due to maintenance, updates, or circumstances beyond our control (including those of providers like Meta/WhatsApp, Google, Anthropic, OpenAI, Stripe, or Railway).

Target SLA: 99.5% monthly uptime. Planned downtime will be announced in advance when possible.

11. Limitation of liability

To the maximum extent permitted by law, PumpFlow will not be liable for:

• Lost profits, lost business opportunities, or reputational harm
• Loss or corruption of data (beyond restoring from the latest backup)
• Indirect, consequential, or punitive damages
• Outages caused by third-party providers
• AI-generated content that proves inaccurate

Our maximum aggregate liability in any case is limited to the amount you paid in the 12 months preceding the event giving rise to the claim.

Nothing in these terms excludes liability for willful misconduct, gross negligence, death or personal injury, or other matters that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold PumpFlow harmless against any third-party claims arising from:

• Your breach of these terms
• Content or data you upload to the service
• Use of the service to send messages to your leads without proper legal basis
• Violation of applicable laws or third-party rights

13. Termination

You can terminate your account at any time from the dashboard. We may suspend or terminate your account if:

• You breach these terms
• You don't pay within the established timeframes
• You engage in activities that endanger the security or reputation of the service
• Required by law or competent authority

14. Governing law and jurisdiction

These terms are governed by Spanish law.

Any dispute will be submitted to the courts of Madrid, Spain. If you're a consumer, any mandatory consumer jurisdiction rules will be respected.

15. Changes

We may modify these terms when necessary. Material changes will be notified at least 30 days in advance. If you don't agree with the changes, you can cancel your subscription before they take effect.
